For several years prior to August 16, 1950 Stanley Kosteczko had been employed by State Fair Park, Inc., as an operator of an amusement device known as the 'Loop'. On August 16, 1950, for a period of about forty-five minutes prior to closing time the 'Loop' had had no patronage. In the close vicinity of the 'Loop' was another device known as the 'Whip'. During the period of inactivity at his station Kosteczko took a seat in the 'Whip' and while it was engaged in carrying him and other passengers on a 'ride' the former fell or was thrown out of the device and was killed. Claim for compensation under the provisions of the Workmen's Compensation Act, St.1951, § 102.01 et seq., was filed with the Industrial Commission by deceased's mother and was denied. An action to review the order of the commission was brought in the circuit court for Dane County. Judgment confirming the order was entered on February 17, 1953. Claimant appeals.
